1. Acceptance of Terms

By accessing or using MotionDrop (motiondrop.net), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

MotionDrop is an AI-powered video ad generation platform ("Service") operated by MotionDrop. These terms constitute a legally binding agreement between you ("User," "you") and MotionDrop ("we," "us," "our").

We may update these terms from time to time. Your continued use of the Service after changes are posted constitutes acceptance of the updated terms.

2. Account Registration

To use certain features of the Service, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security and confidentiality of your login credentials.
• Accept responsibility for all activity that occurs under your account.
• Notify us immediately of any unauthorized use of your account.

You must be at least 18 years of age to create an account and use the Service. We reserve the right to suspend or terminate accounts that violate these terms.

3. Plans & Pricing

MotionDrop offers the following plans:

• Free Plan: 3 video generations total, 720p export, MotionDrop watermark included. No credit card required.
• Starter Plan ($9/month): 20 video generations per month, 720p HD export, no watermark, all templates and styles. Billed monthly.
• Pro Plan ($29/month): 100 video generations per month, 1080p HD export, no watermark, all templates and styles, custom text overlays, and priority rendering. Billed monthly.

All prices are in US dollars. Pricing is subject to change with reasonable notice. The Pro plan renews automatically each month until cancelled. You may cancel your subscription at any time, and access will continue through the end of the current billing period.

All payments are processed securely through Stripe. MotionDrop does not store your full payment card details. By providing payment information, you authorize us to charge the applicable fees to your chosen payment method.

4. Content Ownership

Your Content: You retain full ownership of all images, URLs, and other materials you upload or provide to the Service ("Input Content"). You represent and warrant that you have the right to use any Input Content you submit.

Generated Videos: Videos generated by MotionDrop using your Input Content are owned by you. You are granted a perpetual, worldwide, royalty-free license to use, modify, distribute, and commercially exploit your generated videos for any lawful purpose.

• No attribution to MotionDrop is required.
• Commercial use is fully permitted, including in paid advertisements, social media, websites, and presentations.
• You may not resell the AI generation service itself or claim the underlying technology as your own.

Our Rights: We reserve the right to use anonymized, aggregated data to improve the Service. We will not use your specific Input Content or generated videos for marketing purposes without your explicit consent.

5. Acceptable Use

You agree to use MotionDrop only for lawful purposes. You must not submit, upload, or use the Service to generate content that:

• Is illegal, harmful, threatening, abusive, harassing, defamatory, or obscene.
• Infringes on the intellectual property rights of others, including trademarks, copyrights, or patents.
• Contains or promotes violence, hate speech, discrimination, or exploitation of minors.
• Is sexually explicit or pornographic in nature.
• Constitutes fraud, impersonation, or misrepresentation.
• Contains malware, viruses, or any harmful code.
• Violates any applicable law or regulation in your jurisdiction.

You also agree not to:

• Attempt to reverse-engineer, decompile, or extract the source code of the Service.
• Use automated scripts, bots, or scrapers to access the Service beyond its intended interface.
• Circumvent usage limits, rate limits, or access controls.
• Share your account credentials with third parties or operate multiple free accounts to bypass plan limits.

Violation of these terms may result in immediate account suspension or termination without notice or refund.

6. AI-Generated Content

MotionDrop uses artificial intelligence to generate video content. By using the Service, you acknowledge and agree that:

• No guarantee of specific results. AI-generated output may vary in style, quality, and interpretation. We do not guarantee that any generated video will meet your exact expectations or requirements.
• Variability. The same input may produce different outputs across multiple generations. This is inherent to AI-based content generation.
• Not a substitute for professional production. While MotionDrop produces high-quality video ads, the output is generated by AI and may not perfectly replicate human-directed video production in all cases.
• Your responsibility. You are solely responsible for reviewing generated content before using it commercially. You must ensure that generated videos are appropriate and compliant with applicable advertising standards and regulations in your jurisdiction.

MotionDrop makes no warranties, express or implied, regarding the accuracy, completeness, or fitness for a particular purpose of any AI-generated content.

7. Refund Policy

Due to the nature of digital products and AI-generated content, all video generations are non-refundable. Once a video has been generated, the computational resources have been consumed and cannot be recovered.

• Pro Plan: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused time within a billing cycle.
• Service Issues: If the Service experiences a technical failure that prevents video generation after payment has been collected, please contact us at admin@motiondrop.net. We will either re-process your video or issue a credit to your account at our discretion.

8. Termination

By You: You may close your account at any time by contacting us at admin@motiondrop.net. If you have an active Pro subscription, it will be cancelled and access will continue through the end of the current billing period.

By Us: We reserve the right to suspend or terminate your account, without prior notice, if we determine in our sole discretion that you have:

• Violated these Terms of Service or any applicable law.
• Engaged in abusive, fraudulent, or harmful behavior.
• Submitted content that violates our Acceptable Use policy.
• Attempted to exploit, disrupt, or compromise the integrity of the Service.

Upon termination, your right to use the Service ceases immediately. Videos you have already downloaded remain yours under the ownership terms described in Section 4. We are not obligated to retain any data associated with your account after termination.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory.
• MotionDrop shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
• Our total aggregate liability for any claims arising under these terms shall not exceed the total amount you have paid to MotionDrop in the twelve (12) months preceding the event giving rise to the claim.
• We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components.

You agree to indemnify and hold MotionDrop, its officers, employees, and affiliates harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these terms, or your infringement of any third-party rights.

10. Changes to Terms

We may revise these Terms of Service at any time. When we make material changes, we will update the "Effective Date" at the top of this page and post the revised terms here.

For significant changes that materially affect your rights or obligations, we will make reasonable efforts to notify you via email or through a prominent notice within the Service at least 14 days before the changes take effect.

Your continued use of MotionDrop after updated terms are posted constitutes your acceptance of the revised terms. If you do not agree with the changes, you should discontinue use of the Service and close your account.
